General Terms and Conditions of Sale (GTCS)

Article 1 - SCOPE / GENERAL

www.salamaparfums.com is the E-Commerce website of the company SALAMA PARFUMS SARL, chemin de Pinchat 3A, 1227 Carouge, Switzerland. Its offer is limited to the territories of Switzerland and Liechtenstein.

The present General Terms and Conditions of Sale (hereinafter GTCS) apply to all the services of SALAMA PARFUMS SARL. SALAMA PARFUMS SARL reserves the right to change them at any time. In this case, these modifications shall apply as soon as they are published on www.salamaparfums.com.

Article 2 - ORDERING AND CONTRACTUAL LINKS

All orders must be placed on www.salamaparfums.com after the Client has registered and accepted these GTCS.

After the order has been published, the Client receives a confirmation e-mail. A contract is concluded between the Client and SALAMA PARFUMS SARL from the moment the order is confirmed. SALAMA PARFUMS SARL has the right to contest an order by not certifying it.

The products on sale on www.salamaparfums.com are described as accurately as possible, with photos of the best possible quality. However, there may be discrepancies between the products delivered and the descriptions and photos. The information is given subject to errors in description and illustration.

Exchange of products is not acceptable. Unpacked goods can be returned within ten days with the agreement of the Client Service. Any certified order is firm and definitive, with no possibility of modification. Any defects must be reported within ten days of receipt of the goods, failing which the delivery is recognised as accepted. Any hidden defect must be reported to the Client Service Department immediately after its discovery (see Article 8. Customer Service and Complaints).

If the order has been confirmed, but the products cannot be delivered, the Client will be notified within three working days. The payment made will be refunded. Any claim for non-receipt of the order or for late delivery will be refused. The products delivered remain the property of SALAMA PARFUMS SARL until the invoice has been paid in full.

Article 3 - REGISTRATION

Only adults residing in Switzerland or Liechtenstein may register free of charge. This is not equivalent to a right of access to the online shop. When registering, the customer must specify his or her details: first name, surname and official address. The delivery address can be chosen in Switzerland or Liechtenstein. Any change of name or surname must be reported to the Client Service, which will then make the corresponding changes.

Article 4 - PRICES

The prices are those published on www.salamaparfums.com, in Swiss francs, including VAT.

Article 5 - PAYMENT

All the means of payment indicated on www.salamaparfums.com are accepted. The Client does not have the possibility of paying for his purchases in monthly installments or in several payments.

Article 6 - SHIPMENT AND DELIVERY

6.1 SHIPMENT OF THE GOODS

The goods are delivered directly to the address and person specified by the Client.

6.2 DELIVERY DATES/TIMES AND COMPLIANCE WITH DEADLINES

SALAMA PARFUMS SARL and its delivery partners do everything possible to respect the delivery dates and times. The information provided in this respect by SALAMA PARFUMS SARL is only approximate. A delay does not constitute a valid reason for cancellation of the order and does not give the right to any compensation. If SALAMA PARFUMS SARL or its delivery partners are unable to fulfill a confirmed order, SALAMA PARFUMS SARL cannot be asked to guarantee delivery by other means and the customer is not entitled to claim compensation.

6.3 SHIPPING / DELIVERY COSTS

Delivery is free of charge from 100 CHF of purchase for the territories of Switzerland and Liechtenstein.

6.4 DELIVERY NOTE AND INVOICE

Delivery notes and invoices are sent electronically if possible.

6.5 DELIVERY

For reasons of quality and security, SALAMA PARFUMS SARL endeavours, as far as possible, to have the goods delivered by la POSTE. The General Terms and Conditions of la POSTE shall apply.

La POSTE and SALAMA PARFUMS SARL decline all responsibility for delays in delivery.

6.6 CANCELLATION OF DELIVERY

In the event that delivery is impossible or almost impossible beyond the control of SALAMA PARFUMS SARL, the company is free to cancel the order. Any claim by the client for compensation in kind or in damages is totally refused.

Article 7 - TRANSMISSION / USE OF DATA AND SECURITY

The provisions of the data protection declaration of SALAMA PARFUMS SARL apply.

Article 9 - FINAL PROVISIONS AND FORCE

Should parts of these GTCS be inapplicable or invalid for any reason, the validity of the remaining provisions shall not be affected. Swiss law shall apply exclusively. For natural persons, the place of jurisdiction is Geneva or the commune where they are domiciled. For legal entities, the sole place of jurisdiction is Geneva.
